By accessing or using Passport Photo Ready ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Service Description

Passport Photo Ready provides automated photo formatting only. We:

• Format photos according to publicly available US passport photo specifications
• Do NOT verify identity
• Do NOT submit photos to any government agency
• Are NOT affiliated with or endorsed by any government
• Do NOT guarantee acceptance by any authority

We are a photo preparation tool, not an official or government-certified service. Final acceptance of any passport photo is at the sole discretion of the reviewing government authority.

3. User Responsibilities

By using our Service, you agree to:

• Upload only photos of yourself or photos you have permission to use
• Confirm that you are the person in the photo, or have explicit legal authority to submit the photo (e.g., parent/guardian of a minor)
• Provide accurate information, including a valid email address
• Not use the Service for any illegal or unauthorized purpose
• Not upload inappropriate, offensive, or illegal content
• Not use processed photos for fraudulent documents, identity theft, or impersonation
• Not use the Service to create photos for fake or forged identification documents
• Accept full responsibility for any legal consequences arising from misuse of processed photos

4. Photo Requirements

For best results, your uploaded photo should be a recent, front-facing photo with good lighting, neutral expression, and eyes open. While our AI processing improves photos to meet passport standards, the quality of the output depends on the quality of the input photo.

5. Payment and Refunds

• Payment is required before photo processing
• All payments are processed securely through Stripe
• Prices are in USD and include all applicable fees
• Refund Policy: Refunds are available if your processed photo is rejected by a passport authority for not meeting compliance requirements. To request a refund, you must provide evidence of rejection (e.g., rejection notice or email from the passport office). Contact us at hello@passportphotoready.com with your rejection evidence within 30 days of purchase.

6. No Guarantee of Acceptance

While we process photos according to US passport specifications, we cannot guarantee that your photo will be accepted by the US Department of State or any other government agency. Final acceptance is at the discretion of the reviewing authority. We are not responsible for rejections due to factors outside our control.

Our photo formatting is based on publicly available guidelines and common formatting standards. We make no representations about compliance with any specific government requirements. The term "passport photo" refers to the photo format commonly used for identification documents, not an endorsement or certification by any government entity.

7. Intellectual Property

You retain all rights to your uploaded photos. By using our Service, you grant us a limited license to process your photos solely for the purpose of providing the Service. We do not claim ownership of your photos and do not use them for any other purpose.

8. Limitation of Liability

To the maximum extent permitted by law, Passport Photo Ready shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from your use of the Service. Our total liability shall not exceed the amount you paid for the Service.

9. Indemnification

You agree to indemnify, defend, and hold harmless Passport Photo Ready, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any misuse of photos processed through our Service

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
